Article 2, section 1:
The executive power shall be vested in a President of the United States of America. He shall hold his office during the term of four years, and, together with the Vice President, chosen for the same term, be elected, as follows:Now, while not saying outright that the VP is part of the executive, it does seem to infer that the the executive power is vested in the President along with the VP.
And from the whitehouse.gov website:
The power of the executive branch is vested in the President, who also serves as Commander in Chief of the Armed Forces. The President appoints the Cabinet and oversees the various agencies and departments of the federal government.And then, if you go to the cabinet page and scroll down, you find this.
In order for a person to become President, he or she must be a natural-born citizen of the United States, be at least 35 years of age, and have resided in the United States for at least 14 years. Once elected, the President serves a term of four years and may be re-elected only once.

I know this is like superficial and a bit stupid, but I'd sure like to know what the hell he's basing his statement on.

Honestly, Cheney is a menace.

If cheney wants to claim he's not part of the Executive Branch, let's:
Evict him from government property.
Cancel any/every privilege he has ever claimed.
Stop paying his salary.
Cancel his Secret Service detail.
Take away his Strom Thurman plane, gov. property.
Restrict his travel to commercial airlines or other public transportation.
And call him before congress to testify under oath what he believes his position in government is, if any.
If he wants to claim he's part legislator, FIRE HIM.
or, like i said, just head straight for the tar and feathers. WAAAay more entertaining.
Don't forget the rail! Wouldn't want to violate protocol, right?
