Legally speaking it may be silly, as you say, BUT -- it was exciting to hear the actor saying all the things we wish somebody, anybody, would actually say given the opportunity. TV is insipid most of the time, but this program manages to get in a whole lot of zingers.
Still though, it's all quite conservative. What REALLY should happen is to have Shore bitch slap each and every one of them, especially Scalia, until he cries "uncle" and says, "alright. i get it, there's no getting over bush v gore."
